Cowes Broadband WiFi End User License
  1. Wightcable 2005 Limited and Navigate Solutions LLP (the "Licensor") is the provider of this Wireless Internet (WiFi) network that allows you to connect your WiFi enabled device or laptop computer to the Internet from areas covered by the Cowes Broadband WiFi network (the "Service").
  2. This Licence is between the Licensor and you as a user of the Service and your use of the Service is subject to the term of this Licence. You must be 16 years of age or over to use the Service.
  3. The charges for the Service (the "Charges") are as set out in the Charges section. The Licensor reserves the right to update the Charges at any time. The Licensor is not responsible for any additional charges incurred by you when using the Service.
  4. Your use of the Service is at the discretion of the Licensor and is at your own risk. The Licensor and its contractors and partners, shall not be responsible for and shall be held harmless for any violations of this Licence.
  5. You shall be responsible for any actions of any other person you allow to use the Service under your log-in.
  6. You agree that you will not use the Service for any unlawful purpose, including but not limited to:
    • misuse of copyrighted material or material otherwise protected by third party intellectual property rights;
    • accessing or posting obscene, threatening or abusive material;
    • anything that might cause harm to any third party; or
    • anything that may affect or prejudice the quality of any other communications service, including the Service.
  7. The Licensor reserves the right at its sole discretion to modify, suspend or terminate the Service, or your access to the Service, on reasonable notice (or, where you have breached the terms of this Licence, without notice), and without compensation to you.
  8. Use of the Service is for your use only and not for business use or resale without the consent of the Licensor.
  9. You may not use the Service to send improper or excessive volumes of data that may lead to the congestion of email servers or email in-boxes ("spamming"). Determination of "spamming" under this provision is at the sole discretion of the Licensor.
  10. Web sites and log-in pages may contain links to other web sites. The Licensor is not responsible for the content of any third party web site.
  11. At the location where the Service is provided, the Licensor will take all reasonable steps to make the Service available at all advertised times but the Licensor does not guarantee that the Service is continuous or fault-free, nor shall the Licensor be responsible for your access to the Service being restricted by routine or necessary maintenance or any events outside the control of the Licensor, including, but not limited to: acts of vandalism, acts of terrorism or acts of God.
  12. The Licensor makes no warranties, either express or implied, for the Service. In particular, the Service may be impaired by geographic, atmospheric or other conditions or circumstances beyond our control and the Licensor does not warrant any particular connectivity speed or uninterrupted access to the Service, or that the Service will be available at your chosen location.
  13. The Licensor reserves the right to change the terms of this Licence upon reasonable notice to you. Your continuing use of the Service following notice of a change to the terms constitutes your acceptance of the updated terms.
  14. You are responsible for the legality of any material "mail", "posted", "uploaded" or "downloaded" in your use of the Service.
  15. The Licensor is not responsible for the security of your use of the Service. You are responsible for providing firewall and virus protection software or hardware to suite your individual user needs. You acknowledge that there is no guarantee of the integrity or confidentiality of information transferred over the Internet and therefore users should not rely on the Service to transmit information that requires a failsafe guarantee of delivery or confidentiality.
  16. The Licensor is not responsible for any damages suffered by you or anyone using the Service using your user account or during your log-in session or sessions, whether direct or indirect, including but not limited to personal damages and lost data for any reason.
  17. You agree to indemnify the Licensor on demand against all claims, actions, damages, liabilities, losses, costs and expenses suffered or incurred by the Licensor arising out of any breach by you or this Licence.
  18. This Licence shall be governed by and interpreted in accordance with the laws of England and Wales and you hereby submit to the exclusive the jurisdiction of the English Courts.

You agree that we may use the information you provide to us for marketing purposes, including amongst other things to identify and offer you by phone, post, email or text (SMS) or other means, any further products, services and offers which we think might interest you. If you do not wish your details to be used for marketing purposes, please write to us c/o The Data Controller, Cowes Broadband, 56 Love Lane, Cowes, PO31 7EU or email info@cowesbroadband.com stating your full name and address.
Charges
Charges shall begin once you accept the terms at the start of each timed session. There are no restrictions as to how many times you can log-in and out during your fixed time session.
